Obtaining a Residence Permit by Establishing A Business in Germany
Entrepreneurs and investors who establish a company and do business in Germany can live in Germany by obtaining a residence permit if they meet certain conditions.
Germany requires a Schengen visa for entrepreneurs who are outside the European Union and want to come to Germany for investment purposes.
It is possible for people carrying out commercial activities in Turkey to obtain a Businessvisum (Commercial Visa) through consulates.
These visas, obtained for business reasons, are essentially temporary visas with the same status as tourist visas.
This Schengen business visa obtained does not constitute a guarantee for future residence in Germany.
Residence applications are granted depending on whether the conditions in Article 21 of the German Residence Act (Aufenhaltsgesetz) are fulfilled.
In this law, the requirement to invest at least 250,000 Euros and to employ at least 5 workers throughout Germany, which is required for the residence of foreign entrepreneurs, was abolished with the law amendment made in 2012.
According to this article, foreigners who do business in Germany can be granted a residence permit. The granting of the session is largely at the discretion of the administrative authorities. For this, some conditions are listed in the article of the law. These;
- The investment/work to be made meets an economic need or a regional need,
- The investment / business adds value to the German economy,
- The capital of the investment must be guaranteed either by the investors themselves or by credit.
Of course, whether these conditions are fulfilled is not the area of expertise of the administrative officer, and he or she must get opinions and ask for some documents from authorized public or private institutions. Here, an entrepreneur Turkish citizen should prepare an investment and business plan (Business plan), business concept, capital and financial plan, company profile, estimated profit and loss plan, resume and document health insurance.
It will be easier to get an entrepreneurial session if the opinion of the German Chambers of Industry and Commerce is taken about whether the business to be established fits the market reality, whether it can be carried out, whether it fulfills the necessary conditions.
Entrepreneurs over the age of 45 must also certify an insurance or assets that guarantee their retirement status.
Entrepreneurs who want to establish a company in Germany, take over an established company or become a partner in an established company can do these transactions themselves, or they can take it within the scope of migriva s Business Immigration services.
